Terms & Conditions

Translation notice: The German version prevails in case of discrepancies, subject to mandatory consumer law.
1. Provider and scope
Your contract is with Gurbet eSIM, owner Muhammed Akbas, Bremsberg 12, 59229 Ahlen, Germany. These terms apply to all contracts for digital eSIM products and top-ups concluded via the website or the “Gurbet eSIM” app with consumers and businesses. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (section 13 BGB). Deviating customer terms do not apply unless we expressly agree to them.
2. Product
Digital eSIM profiles/access details are supplied for mobile data in the stated destination. No physical SIM is shipped. Network service is provided through technical eSIM and mobile network partners.
3. Product and network information
The product page governs destination, data allowance, validity, activation and fair-use rules. Speed, 4G/5G availability and coverage depend on device, location, partner network and network load.
4. Contract formation and multiple purchases
The presentation of plans on the website and in the app is not a legally binding offer but an invitation to place an order. The ordering process consists of: (1) selecting the plan on the product page, (2) confirming the terms, the express request to begin performance before the end of the withdrawal period and device compatibility, (3) where applicable choosing the quantity or a Serbia add-on and confirming the fair-use rule, (4) redirection to the payment page of our payment provider Stripe, where email address and payment data are entered and an order summary with the final price is shown. By pressing the payment button on the Stripe payment page, the customer submits a binding offer. The contract is concluded when we accept the offer by an order confirmation email or by providing the eSIM, at the latest upon provision of the eSIM. If a Serbia package is added in the Turkey checkout, the single payment includes a separate Turkey eSIM profile and a separate Serbia eSIM profile. Each profile is delivered by email with its own order number and QR code.
4a. Input errors, contract language and storage of the contract text
Entries can be checked and corrected at any time before the order is submitted: on the product page and in the order step via the respective selection and input fields, on the Stripe payment page via the fields shown there, and via the browser’s back function. The ordering process can be cancelled at any time until the payment button is pressed.
The contract language is German. Translations of the website and these terms into Turkish, Dutch, French and English are provided for information; mandatory consumer protection rules remain unaffected.
We store the contract text (order data). The customer receives the order data (order number, plan, price) by email and can also view it in the protected customer area or in the app. The terms and the withdrawal information are available on this website only in their current version; we therefore recommend saving or printing them before ordering using the browser’s print or save function.
5. Prices and payment
The prices displayed at the time of the order apply. All prices are final prices. As a small business within the meaning of section 19 UStG (German VAT Act), we do not charge VAT, so no VAT is shown. There are no shipping costs for digital delivery.
Payment is processed by Stripe. Depending on availability, card payments (including Apple Pay or Google Pay where applicable), PayPal, Klarna and bank transfer are offered; the payment methods shown on the Stripe payment page are decisive. The terms of PayPal and Klarna additionally apply to those methods. The price is due immediately upon conclusion of the contract. For bank transfers, the eSIM is provided only after receipt of payment.
6. Digital delivery
Before the eSIM or top-up is provided, the customer receives a contract confirmation by email containing the contract details, these terms, the withdrawal information and confirmation of their declarations on the early start of performance. The eSIM is sent to the supplied email address as a QR code, installation link or manual details. The customer must provide a correct email and check spam folders.
7. Compatibility and customer duties
The customer must check eSIM support, absence of a SIM lock and destination suitability before purchase. Installation normally requires internet access. QR codes must not be shared or reused contrary to technical instructions.
8. Activation, validity and fair use
Validity begins as described on the product page/eSIM profile, often upon first connection to a supported network. Unlimited plans may include fair-use limits or speed reductions.
8a. Top-ups
For certain eSIMs, additional data can be booked via the protected customer area (“Check data usage”) or the app. These terms apply accordingly to top-ups, in particular sections 4 to 8, 10 and 11. The additional data is assigned to the existing eSIM; no new QR code is required. Validity, data volume and price are shown before payment.
9. Promotions, vouchers and refer a friend
A customer with a successfully paid Gurbet eSIM order may share their personal referral link. Each referred new customer receives a one-time €2.50 discount on orders of €9.99 or more.
For every successfully paid and fulfilled referred order, the referrer receives a personal €2.50 voucher for a later order of €9.99 or more. Each voucher is valid for one year and can be redeemed once. No more than one voucher may be used per order. Combining discounts, cash payment, transfer, sale, self-referrals and misuse are excluded.
9a. Loyalty bonus and email consent
Participation is optional and is not required to buy. After selecting marketing consent, a confirmation email is sent first (double opt-in). Only after confirmation does the customer receive a personal 10% code for a later order of at least €9.99. The code is valid for one year, single-use, non-transferable and cannot be combined with referral, credit or other discount codes. Only one voucher may be used per order. Marketing consent may be withdrawn at any time for the future.
10. Statutory rights for digital products
Consumers retain statutory remedies for failure to supply or non-conformity of digital products, including cure, termination, price reduction and damages where applicable.
11. Withdrawal
Consumers generally have a statutory right of withdrawal; see the withdrawal information. Since 19 June 2026, withdrawal can also be submitted through “Withdraw from contract”. The right expires only under the applicable statutory conditions.
12. Voluntary refunds
Outside statutory claims, refunds are assessed case by case. Statutory withdrawal and conformity rights remain unaffected.
13. Liability
Liability is unlimited for intent, gross negligence, injury to life, body or health and mandatory law. For slight negligence regarding essential duties, liability is limited to foreseeable typical damage.
14. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body (section 36 VSBG). For questions and complaints, customers can reach us at info@gurbetesim.de.
14a. Google Maps content
Current reviews, aggregate ratings and author information displayed on the website may originate from Google Maps or Google Places API. This third-party content is additionally subject to the Google Maps Platform Terms and Google’s user-generated content policies. The version available through the respective Google Maps source link is authoritative. Gurbet eSIM does not adopt third-party review text as its own statement and does not guarantee uninterrupted availability of Google’s service. Statutory rights against Gurbet eSIM remain unaffected.
15. Use of the Gurbet eSIM app
- The mobile app “Gurbet eSIM” for Android and iOS is provided by Gurbet eSIM, owner Muhammed Akbas, Bremsberg 12, 59229 Ahlen, Germany. The contracting party for all contracts concluded in the app is exclusively Gurbet eSIM. Google (Google Play) and Apple (App Store) are not parties to the contract and are not responsible for the content, services, support or warranty of the app or the eSIM services purchased through it.
- Downloading and using the app is free of charge. Only the eSIM plans and top-ups expressly shown with a price in the app are chargeable.
- These terms apply unchanged to purchases in the app, in particular sections 4 to 8. The required confirmations are requested in the app before redirecting to payment. The order is concluded bindingly on the payment page of our payment provider Stripe by pressing the payment button shown there. The final price shown on the payment page is decisive.
- The eSIM is delivered by email as before. In addition, installation data, status and data usage may be shown in the app; usage data comes from our technical provider and may be delayed.
- Sign-in works without a password via a time-limited sign-in link or code sent to the email address used for the order. For security reasons the session ends if the app is not used for more than 10 minutes. Installation data (QR code, activation code) must be kept confidential.
- The app account can be deleted at any time in the app under “Profile → Delete account”, via https://www.gurbetesim.com/konto-loeschen.html or by email to info@gurbetesim.de. Existing contracts and statutory retention obligations remain unaffected.
- Withdrawal can also be declared in the app via the “Withdraw from contract” function (section 11 and withdrawal policy).
- We strive to keep the app available with as few interruptions as possible but do not guarantee uninterrupted availability. The eSIM service owed under the contract remains unaffected.
- The app requires a supported Android or iOS device. The customer checks before purchase that the device supports eSIM and is not SIM-locked (section 7).
16. Applicable law and final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, without affecting mandatory consumer protection rules of the country of the consumer’s habitual residence. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Ahlen. Should individual provisions be invalid, the remaining provisions remain unaffected.
